Conditions of Participation

By submitting your story to, (herein referred to as Grief's Heart), you and Thomas Attig explicitly agree to be legally bound by the following Agreement that specifies conditions regarding what you submit:

You warrant that you own the story you submit, that it does not infringe any other's copyrights, and that the identifying information you provide is correct. Grief's Heart disclaims all responsibility for the accuracy or ownership of material submitted.

By virtue of your writing the stories, the copyright in them remains your property. You may send your stories to other print or electronic publications if you desire. By virtue of his creating the content of Grief's Heart, Thomas Attig retains all right, title, and interest in the content of the web site excluding submitted stories.

Grief's Heart will hold as confidential all information submitted by you other than that which you explicitly authorize us to post.

You grant the owner of Grief's Heart the royalty-free and non-exclusive right and license to use, reproduce, publish, edit, post, archive, and distribute your stories on or through and any Internet site or service delivering the content of that web site on the Internet as long as Grief's Heart remains in operation. No compensation other than the service of posting your stories is due to you.

You permit users of this web site to access, view, store, or reproduce your stories for their personal use only. You will not hold Grief's Heart, it's owner, staff, or any other party connected with Grief's Heart responsible in any way if someone else violates your copyrights in the stories you submit.

Grief's Heart reserves the right to reject any story for any or no given reasons. Please do not submit any unlawful, threatening, libelous, defamatory, obscene, pornographic, or profane material. And take due care to respect the privacy and sensitivities of those you write about. You are solely responsible for characterizations of others in your stories.

Except for correcting spelling, punctuation, or grammar or formatting your story to fit the page, Grief's Heart pledges to consult with you before posting stories with any other alterations. We wish to leave your stories intact, in the detail, style, and voice that you choose for them.

You have the right to demand withdrawal of your story from Grief's Heart if in your opinion its remaining on the site interferes with or is detrimental to your interests or reputation, might subject you to liability for any reason, or interferes with the rights of another. We will remove your stories within seven days of receipt of any such request submitted in writing by mail or Federal Express addressed to the owner of Grief's Heart with return receipt requested. Such withdrawal will terminate this Agreement.

You agree to defend, indemnify and hold Grief's Heart, its owner, staff, or any other party connected to Grief's Heart harmless from and against any and all claims, liabilities, judgments, penalties, and taxes, civil or criminal, and all costs and expenses (including but not limited to attorneys' fees) arising from any breach of your representations and affirmations or violation of any third-party's rights, including but not limited to infringement of any copyright, violation of any proprietary right, and invasion of any privacy rights. This obligation will survive any termination of this Agreement.

The provisions of this Agreement shall be binding upon and pass on to the benefit of you and Thomas Attig and to your and his heirs, administrators, successors, and assigns.

This Agreement is governed in accordance with the laws of the State of California. All disputes under it shall be resolved in the courts of that state including its federal courts. Those bound by the Agreement consent to the jurisdiction of such courts and waive any jurisdictional or venue defenses otherwise available to them. If legal action is brought to enforce this Agreement, the successful party will be entitled to recover reasonable attorney fees and other costs incurred in addition to any other relief to which they may be entitled.

Viewing of stories and other materials posted on Grief's Heart is governed by the "Terms of Use and Agreement" of this web site. (Click here to review them.)

Grief's Heart will notify Resident Authors (using the most current e-mail addresses on file) of any changes in these Terms of Use or if any part of the web site ceases operation.
